Rao Junior Colleges can conduct FYJC Admission 2020

Bombay HC allows Rao Junior Colleges to conduct admissions

Earlier, state education department rejected the recognition to Rao Junior Colleges in the city, now the Bombay high court (HC) on Wednesday allowed them to conduct admissions for the current academic year. A bench of justice Milind Jadhav and justice KK Tated observed that as per the Maharashtra Self-Financed Schools (Establishment and Regulation Act), 2012, “no order or withdrawal of permission shall be passed unless a reasonable opportunity of being heard is given to such trust or society or local authority”. This was reply to a writ petition filed by Rao Educational Trust.

As per the petitioner, the department had not given a chance to be heard. The court has further asked the education department to give a personal hearing to the college within a period of four weeks from the date of the order.

HC has asked the education department to direct the competent authority to ‘publish supplementary notification on the website of standard 11 Centralised Admission Process 2020-21 for Mumbai Metropolitan Region giving information about the petitioner’s colleges for admissions to FYJC Science’.

The court order also said that while students are entitled to admissions in the five junior colleges run by the group, it will be ‘subject to outcome of the present litigation’. Students admitted for Class 12 in the Rao Group of colleges can continue to study there.

The education department had cracked a whip against eight junior colleges, including five of the Rao group, in the city for not following norms with respect to infrastructure. Meanwhile, FYJC First Merit List 2020 is coming up on August 30.

11th admission first list 2019 for Mumbai, Pune

11th admission first list 2019 for Mumbai, Pune

As per state education department’s report 299 of 39,476 FYJC seats in 73 colleges were filled illegally last year.

Only a few colleges in Mumbai and Pune were monitored in the FYJC admission process. The total intake for students in Mumbai was 2.6 lakh last year, the actual number of seats that were illegally filled via 11th online admission could be much more.

Third parties were involved to audit colleges to maintain transparency, after the 11th admission process was over last year, as per the orders of the Bombay High Court and the state government. The main objective was to make sure that all colleges admitted open-category students via the online admission process, and then followed the department’s norms while admitting students to quota seats for the admission process.

Pune-based non-government organisation (NGO), Syscom, challenged the audit and its findings. Previously, the organisation has filed public interest litigations (PIL), to streamline the 11th admission process and remove any errors in the system.

Activists questioned why the report not covered all the colleges in Maharashtra. “The audit was ordered by the Court for the entire state, but the education department only held it in a few colleges in Mumbai and Pune,” said Vaishali Bafna, NGO member and one of the petitioners. “If they cover all colleges, more illegal admissions would then have been reported.”

Even the audit report not made public — it was accessed by the NGO after repeated Right to Information (RTI) queries. The report shows that in Pune, the audit was held by an expert committee having former education officials, but in Mumbai officials visited colleges themselves.

Bafna said, “No specific parameters were fixed for the audit; audit committee meeting records are not found or no recommendations". The audit did not check if 11th admissions were merit-based. “The audit was done as an eye wash by the education department. No investigation was done neither questioned any of the information provided by the colleges.”
